Performing Agreement

THIS AGREEMENT made as of _____________________________________ between

____________________________ (the "Artist/Band") of ________________________ and

Musicians Against Hate (Pennsylvania Network of Unity Coalitions - promoter) of 3523 North Second St. Harrisburg, PA 17110.

WHEREAS:

A. The Promoter is a promoter of the Musicians Against Hate a concert(s); and

B. The Promoter wishes to authorize the Artist to perform in accordance with the terms and

conditions of this Agreement;

NOW THEREFORE in consideration of the recitals, the mutual covenants hereinafter set forth,

and for other good and valuable consideration, the receipt and sufficiency of which is hereby

acknowledged, the parties hereto hereby agree as follows:

1. The Promoter hereby authorizes the Artist/Band to perform, and the Artist/Band agrees to

perform a set of music for no more than 45 minutes or extended at the discretion of the

promoter (the "Performance") in Harrisburg, PA (the "Venue") on May 17th,

2008 at __________ until _________ am/pm EST.

2. The Promoter agrees to furnish the Venue at its own expense on the date at the time

mentioned for the Performance, and with all necessary distribution of circulars, daily display and advertising

in the principal newspapers at the Promoters discretion.

3. All musical instruments and equipment required for the performance shall be provided by

the Artist/Band at its own expense. The use of any profanity, or discriminatory verbage used in lyrics by the

Artist/Band that is contradictory to the mission of MusiciansAgainstHate will automatically void this contract.

4. The Artist/Band agrees to furnish the Promoter ad copy, i.e. logo, web address, email

address (if any or all available), and agrees to allow the promoter to use these to

promote the concert(s).

5. The Promoter agrees to use reasonable commercial efforts to publicize the Performance in

order to maximize attendance at the Performance. The Artist/Band agrees to properly

distribute and display all advertising material it receives from the promoter, and the

Promoter hereby gives Artist/Band permission to independently print and distribute all

authorized advertising copy provided by the Promoter.

6. As consideration for agreeing to give the Performance, the Promoter also agrees to place a

photo, web link, and contact information (if any or all available) of the Artist/Band on

the MusiciansAgainstHate.bravehost.com web site.

7. In case of sickness of, or of accident to the Artist/Band, or if the performance is rendered

impossible or unfeasible by any act or regulation of any public authority, civil tumult, riot,

strike, epidemic, interruption, delay, cessation, or interference with transportation

services, or for any other cause beyond the control of the Artist/Band, it is agreed that

there shall be no claim for damages by either party to this Agreement, and the

Artist/Band's obligation as to the Performance shall be considered to be waived.

8. This Agreement represents the full understanding between the parties hereto, and the

Artist/Band shall not be bound by any terms or undertaking other than those contained in

this Agreement. This Agreement may not be assigned by the Promoter, but shall be

binding on the Promoter and the Promoter's personal representatives and successors. No

consent of the Artist/Band or the Promoter required to be given shall be valid unless

signed in writing by the Artist/Band or the Promoter.

Release and Indemnity

RE: Musicians Against Hate concert to be held on May 17, 2008

IN CONSIDERATION OF being permitted to participate in the Event, the undersigned, on

behalf of myself, my heirs, executors, administrators and assigns, hereby:

Acknowledges that the undersigned's participation in the Event may include

activities that may be hazardous to the undersigned and assumes the risk of injury or harm

associated with such participation.

Releases and forever discharges the Musicians Against Hate and its

employees, officers, directors, shareholders, affiliates, agents, representatives, sponsors,

successors and assigns (collectively the "Releasees") of and from all liability, claims,

demands, damages, costs, expenses, actions and causes of action (collectively the

"Claims") in respect of death, injury, loss or damage to myself or property howsoever

caused, arising or to arise by reason of or during my participation in the Event, whether

prior to, during or subsequent to my attendance and notwithstanding that any Claim may

have been contributed to or occasioned by the negligence of any of the Releases.

Indemnifies and saves harmless the Releases from and against any and all liability

incurred by any or all of them arising as a result of or in any way connected to my

participation in the Event.

Understands and acknowledges that the Musicians Against Hate does not

carry or maintain health, medical or disability insurance coverage for the undersigned and

therefore agrees to assume responsibility for such insurance coverage on the undersigned.

Agrees that in the event that any provision of this Release and Indemnity is held to

be invalid or unenforceable by any court of competent jurisdiction, the invalidity or

unenforceability of such provision will not affect the remaining provisions of this Release

and Indemnity which shall continue to be enforceable.

I HEREBY ACKNOWLEDGE READING, UNDERSTANDING AND AGREEING WITH

THE FOREGOING.
